Terms of Service

1. Acceptance of Terms

By accessing or using the Enigma Releasing platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Diamond Dog Film (BV), a Belgian company registered under BE 1008.209.783.

Important Notice

By creating an account, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Provide your real name (no pseudonyms, aliases, or fake names)
  • Use a valid email address you have access to
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Service under applicable law

Real Name Policy

We use AI-powered verification (Perplexity) to ensure users provide their real names. Fake names, celebrity names, or obvious pseudonyms will be rejected during signup. This policy ensures authenticity and trust within our community.

3. Account Registration & Security

3.1 Account Creation

When creating an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

  • You are responsible for all activities under your account
  • Notify us immediately if you suspect unauthorized access
  • Do not share your password or account access with others
  • We are not liable for losses due to unauthorized account use

3.3 One Account Per Person

You may only create and maintain one account. Multiple accounts created by the same person may be suspended or deleted.

4. Acceptable Use Policy

You agree NOT to use the Service to:

Prohibited Content

  • • Illegal or harmful content
  • • Hate speech or discrimination
  • • Harassment or bullying
  • • Explicit or adult content
  • • Violence or threats

Prohibited Activities

  • • Spam or unsolicited messages
  • • Impersonation of others
  • • Copyright infringement
  • • Scraping or automated access
  • • Hacking or security breaches

Prohibited Behavior

  • • Manipulating ratings/reviews
  • • Creating fake accounts
  • • Circumventing restrictions
  • • Interfering with others' use
  • • Violating others' privacy

Technical Restrictions

  • • Reverse engineering
  • • Introducing malware/viruses
  • • Overloading servers (DDoS)
  • • Bypassing security measures
  • • Automated data collection

5. Content Moderation

5.1 Our Right to Moderate

We reserve the right to review, remove, or restrict access to any content that violates these Terms or is otherwise objectionable. We may take action with or without notice.

5.2 Automated Moderation

We use automated tools to detect spam, profanity, and prohibited content. Rate limits apply:

  • Maximum 10 posts per hour
  • Maximum 50 posts per day

5.3 User Reporting

Users can report content they believe violates these Terms. All reports are reviewed by our moderation team.

5.4 Consequences of Violations

  • Warning: First offense - you'll receive a warning
  • Content Removal: Violating content will be deleted
  • Temporary Suspension: Repeated violations may result in suspension (1-30 days)
  • Permanent Ban: Severe or repeated violations may result in permanent account termination

5.5 Appeals Process

If you believe a moderation action was taken in error, you may appeal the decision. We will review appeals within 14 days.

6. Intellectual Property

6.1 Platform Content

All content on the Service, including text, graphics, logos, code, and design, is owned by Diamond Dog Film (BV) or our licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 User-Generated Content

When you post content (reviews, ratings, posts, images) on the Service, you:

  • Retain ownership of your content
  • Grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on the Service
  • Represent that you own or have rights to the content you post
  • Take responsibility for any infringement claims

6.3 Film Data & TMDB

Film metadata (titles, posters, cast, crew) is sourced from The Movie Database (TMDB) and is used under their license. This content is owned by the respective copyright holders.

6.4 Copyright Infringement Reporting

If you believe content on our Service infringes your copyright, contact us at:

6.5 Repeat Infringer Policy

Users who repeatedly post infringing content will have their accounts terminated (3 strikes policy).

7. Email Communications

7.1 Transactional Emails

We will send you transactional emails related to your account (password resets, security alerts, etc.). You cannot opt out of these essential communications.

7.2 Marketing Emails (Newsletter)

With your consent, we may send you marketing emails about new films, features, and updates. You can unsubscribe at any time using the link in any email or through your account settings.

7.3 Email Tracking

With your consent, we track email opens and clicks for analytics purposes. You can opt out of tracking while still receiving emails.

8. Service Availability

We strive to provide reliable service, but we do not guarantee uninterrupted or error-free access. The Service may be unavailable due to:

  • Scheduled maintenance
  • Technical issues or outages
  • Security incidents
  • Third-party service disruptions

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIAMOND DOG FILM (BV) SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages resulting from unauthorized access to your account
  • Damages resulting from third-party content or services
  • Service interruptions, errors, or security breaches

Disclaimer of Warranties: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you. Belgian law and EU consumer protection laws remain in full effect.

10. Indemnification

You agree to indemnify and hold harmless Diamond Dog Film (BV), its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Content you post on the Service

11. Account Termination

11.1 Termination by You

You may delete your account at any time through your account settings. Upon deletion, you have a 30-day grace period to cancel. After 30 days, all your data will be permanently deleted and cannot be recovered.

11.2 Termination by Us

We may suspend or terminate your account at any time for violations of these Terms, with or without notice, at our sole discretion.

11.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. We may delete your account and content. Provisions regarding intellectual property, limitation of liability, and dispute resolution survive termination.

12. Governing Law & Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Belgium, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Gent, Belgium.

12.3 EU Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under EU law, including the right to withdraw from distance contracts.

12.4 Informal Resolution

Before filing a legal claim, we encourage you to contact us at julien@enigmareleasing.com to attempt informal resolution.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or prominent notice on the Service.

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service and may delete your account.
